NOTE: SilverHawk Homeowners Petition to Developer

We, the homeowners, want our collective voice to be heard by our developer, SilverHawk, LLC. Changes need to be made to the declaration of covenants, conditions and restrictions filed with the City of Oklahoma City that has allowed in Section 5 residential units that do not meet the criteria in building media, quality and appeal that will preserve consistency in our addition. This is contrary to what we were presented by our developer and/or sales associate at the time we purchased our lots and/or built our homes in Silverhawk.

SilverHawk, LLC. is allowing the construction of homes by builders, such as Turner & Sons, demonstrating lesser quality construction and design. We propose the by-laws be amended against such future building.

Allowing this to continue could result in lower property values, damage our resale ability and effect future new home sales in the neighborhood.

We the people of SilverHawk ask that we reform our Covenants, Conditions and Restrictions to that of a higher value of workmanship and material percentage allotment.

Suggested Changes

Section 5. Materials.

(a) The right to deviate from the following requirements is not permitted. The principle exterior of any residence shall be at least ninety (90%) percent brick or stone, and ten (10%) percent may be of frame or other materials which will blend together with brick or stone to be used, but in no event shall a continuing wall consisting of seventy (70%) percent of the exterior of the residence be built of any material other than brick or stone. The principal exterior of any two (2) story residence shall be at least ninety (90%) percent brick or stone and ten (10%) percent may be of frame or other materials which will blend together with brick or stone to be used. This restriction is intended to encourage the use of masonry construction on the principal exterior of residences, and may not be modified. There are no exceptions to the above percentages, and there will be no dwelling moved in or transported into the Silver Hawk that was designed in whole or part from a kit, prefabrication, smart-living, modular, or manufactured and placed upon a residential lot. All single family dwellings in must be recognized as quality craftsmanship, originality, and custom designs in order to insure conformity with the original design and planning that ensures residents continued uniformity and a since of quality control. THE EXCEPTION is the Villages WHERE 70% brick or stone and 30% other may be used.

“Dwelling” shall mean any building or portion of a building situated upon a lot

designed and intended for use and occupancy as a residence by a single family.

All single family dwellings on residential lots must include an attached garage, which must accommodate at least two motor vehicles. No dwelling house shall be moved or transported into the subdivision, and be designed in whole or part from a kit, prefabrication, modular, or manufactured and placed upon a residential lot in Silver Hawk. All single family dwellings in Silver Hawk are to be recognized as quality craftsmanship, originality, and custom designs in order to insure conformity with the original design and planning that ensures residents of a since of quality control.
